    Downstream Users - 10 priorities for the REACH revision

    The REACH Regulation is a cornerstone of the EU chemical legislation. Revising REACH means changing the foundation of one of the most comprehensive chemical legislations in the world. Consumers and professional users buy paints, detergents, adhesives, sealants, inks etc., not chemicals. These products, or articles containing these products, are made by DUCC Downstream Users of Chemicals Coordination Group members, including FEICA.

    This paper illustrates the 10 priorities for the REACH revision, as outlined by DUCC and its members.

    FEICA has prepared different Executive Summaries treating as priorities certain initiatives of the European Commission. The European Commission’s proposal to extend the Generic Risk Management Approach (GRA) is considered in this Executive Summary. The approach involves the automatic triggering of management measures based on hazard. The Summary covers the scope of products that could be included in the GRA, as well as the application of the approach to professionals.

    Executive Summaries FEICA Priorities - Reform of the restriction and authorisation process: Essential use concept

    FEICA has prepared different Executive Summaries treating as priorities certain initiatives of the European Commission. This Executive Summary treats the essential use concept, which the European Commission intends to apply to all relevant risk-management legislation. The concept now centres on regulating substances in terms of their societal function regarding human health and safety. Some benefits are anticipated, for example, the speeding up of the authorisation process, and clarity for stakeholders concerning chemical safety and sustainability.

    Diisocyanates restriction compliance for end-users of adhesives and sealants (Version 2)

    On 4 August 2020, a new restriction on diisocyanates was adopted by the European authorities under REACH establishing training requirements prior to the use of PU products containing diisocyanates. The FEICA Technical Working Group 'PU Restriction' created a leaflet (available in eight languages) to guide end-users through the path to compliance.

    This leaflet has now been updated in all 8 available languages.

    A safe future for polyurethane products (Version 3)

    A new restriction on diisocyanates was adopted on 4 August 2020, by the European authorities under REACH, targeting respiratory and dermal sensitisation potentially caused by diisocyanates. The FEICA Technical Working Group 'PU Restriction' created a leaflet (available in eight languages) explaining what the restriction means exactly, how the required training is developing and what the implementation of the timeline is. 

    This leaflet has now been updated in all 8 available languages.

    Webinar Presentation ‘Business impact of the REACH revision on the adhesives and sealants industry’ (FEICA Members only)

    On 17 June 2022, FEICA hosted a webinar on the opportunities and challenges linked to the European Commission’s Chemical Strategy for Sustainability in general and the revision of REACH in particular. Topics included the registration of polymers, the introduction of a mixture assessment factor, potential mandatory reporting requirements for downstream users, and the extension of the generic approach to risk assessment.

    The ‘one substance, one assessment’ approach

    The current legal framework for chemicals’ risk assessment is extremely complex. Through the Chemicals Strategy for Sustainability, the Commission introduced the idea of the ‘one substance, one assessment’ process as a way to ensure that the initiation and priority setting of the safety assessments would be done in a co-ordinated, transparent and, to the extent possible, synchronised manner, taking into account the specificities of each sector.

    FEICA believes that risk management measures should not be a one-fits-all approach, as it would result in unjustified bans by declaring a product unsafe due to the lack of a specific risk assessment targeted to the respective application.

    This publication offers background information and FEICA’s view with regards to the concept of ‘one substance, one assessment’.

    The ‘Essential Use’ Concept

    The ‘Essential Use’ Concept has been developed in the context of a global effort to regulate highly persistent substances in relation to their function in society. Its introduction could affect a myriad of substances, as it would allow a substance to be used only if critical to health and safety or critical for the functioning of society. It could bear substantial adjustment costs for the adhesives and sealants industry, forcing the sector to switch to alternative chemicals not necessarily providing the same technical performance.

    This publication offers background information with regards to the concept of ‘essential use’, FEICA’s view and the next steps.
